Terms of sale

These terms apply to every purchase made on gestionacademicaelena.es. Please read them before you buy: at checkout you are asked to confirm that you accept them.
1. Who you are contracting with
The courses sold on this website under the name Academia Elena are offered by:

In these terms, "we" and "us" mean Gestión Académica Elena, S.L., and "you" means the person who buys a course.
2. What we sell
We sell recorded Spanish courses. Each course is digital content supplied online: recorded video lessons, transcripts, audio drills, worksheets in PDF and exercises with answers. The contents of each course — number of lessons, approximate hours and units — are listed on its course page.
The courses are self-study. They do not include live classes, video calls, private lessons or a teacher assigned to you. Questions about the lessons are answered in writing, by chat or email.
Access to each course lasts 24 months from the date of purchase. Worksheets and audio files can be downloaded during that time.
3. Prices, taxes and payment
Prices are shown in euros (EUR) and include all applicable taxes. The price you pay is the one shown in your basket and on the checkout page at the moment of purchase.
Payments are handled by our payment service provider, which acts as merchant of record (reseller) for the payment: the charge is processed by that provider, and it issues the purchase receipt, which you receive by email. The course itself is supplied by us.
On its payment page, our payment service provider may offer to show and charge the price in the currency of your country. If you choose that option, the provider's exchange rate applies, and it includes a currency conversion fee. You can always choose to pay in euros, at the price shown on our website.
Your card details are entered only on the payment service provider's page. We never see or store them.
4. How a purchase works
- You add one or more courses to your basket and go to checkout.
- You fill in your name, email and billing address. Company name and tax ID are optional.
- You tick the consent box described in section 6 and continue to the payment page of our payment service provider.
- Once the payment is confirmed, you are taken to your personal order page, and the contract is concluded.
You can correct your details at any time before paying, by going back to the checkout form. The contract is concluded in English.
5. Access to the courses
After a confirmed payment we send your access details by email to the address you gave at checkout. They usually arrive within a few hours, and always within one working day. If nothing has arrived by then, please check your spam folder and write to us at hola@gestionacademicaelena.es.
The courses work in any current web browser on a phone, tablet or computer, with an internet connection. Nothing needs to be installed.
Access lasts 24 months from the date of purchase. Files you have downloaded during that time remain yours to use under the licence in section 7.
6. Right of withdrawal and your consent
If you buy as a consumer, Spanish law gives you, as a general rule, 14 calendar days from the date of the contract to withdraw from a distance purchase without giving any reason.
For digital content that is not supplied on a physical medium, article 103(m) of the Spanish consumer law (Real Decreto Legislativo 1/2007, texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios) sets an exception: the right of withdrawal does not apply once supply has started with your prior express consent and your acknowledgement that you lose the right of withdrawal as a result.
This is why the checkout page asks you to tick a box with the following text. You cannot pay without ticking it:
I have read and accept the Terms of Sale, and I ask for access to the courses to start right away. I understand that once access starts I lose the 14-day right of withdrawal for digital content.
In practice:
- Before access starts — that is, before we send you the email with your access details — you can withdraw from the purchase. Write to hola@gestionacademicaelena.es with your name, your order number and a clear statement that you are withdrawing. You may use the official model withdrawal form, but you do not have to.
- Once access has started, the right of withdrawal is lost for the courses in that order, as described above.
If you withdraw in time, we refund the full amount paid without undue delay and at the latest within 14 days of receiving your message. The refund is made through our payment service provider to the same payment method you used.
The right of withdrawal belongs to consumers. If you buy for a business, it does not apply, although you may still write to us about any problem with your order.
7. Personal licence
Every course is licensed to one person: the learner named on the order. The licence is personal, non-exclusive and non-transferable, and lasts as long as your access (downloaded files may be kept for your own study after that).
You may not share your access details or account with anyone else, and you may not copy, resell, publish, upload or distribute the videos, transcripts, audio, worksheets or exercises, in whole or in part. If you want a course for someone else, such as your partner, please buy it for them separately.
All course materials and the contents of this website are protected by intellectual property rights that belong to us or to those who have licensed them to us.
8. If something does not work
We must supply the courses as described on their course pages. If a lesson does not play, a file does not open or something does not match the description, tell us at hola@gestionacademicaelena.es. We will fix it within a reasonable time. Your legal rights as a consumer in case of lack of conformity of digital content remain unaffected by these terms.
9. Liability
The courses teach Spanish. They are not legal, tax or immigration advice, and the preparation course for the nationality exams does not include registration for the exams, exam fees or any part of the nationality application. We cannot guarantee an exam result, because exams are assessed by the bodies that set them.
We are not responsible for interruptions caused by your own device, browser or internet connection, or by events outside our reasonable control. Nothing in these terms limits any liability that cannot be limited under the law, including our liability towards consumers.
10. Questions and complaints
If you have a question or a complaint about a course or an order, write to hola@gestionacademicaelena.es. We answer Monday to Friday, 9:00–18:00 (Spanish time), and we aim to resolve complaints quickly and in writing.
If we cannot reach an agreement, as a consumer you can also turn to the consumer affairs services of your region or of Andalucía, or to the Spanish consumer arbitration system (Sistema Arbitral de Consumo), where both parties agree to it. The official complaint form of the Junta de Andalucía (hoja de quejas y reclamaciones) is available on request at the same address.
11. Applicable law and courts
These terms and every purchase made under them are governed by Spanish law. If you are a consumer, this does not take away the protection given to you by the mandatory rules of the country where you live, and you can bring any claim before the courts of your own place of residence.
12. Changes to these terms
We may update these terms. The version that applies to your purchase is the one published on this page on the day you bought; the date at the top shows the last change.
